Identify whose transaction you are assessing

This guide concerns an individual selling a personal home in Estonia. Company property, property trading as a business and non-resident circumstances need separate checks. Before deciding on a price, record the owners, acquisition method and actual use. A friend’s tax experience is not automatically applicable: similar apartments can have different circumstances.

The core exemption rule

MTA explains that a gain on a dwelling used as your residence until disposal can be exempt. Actual residence matters, not merely a registered address. Prepare a factual timeline

Put acquisition, moving in, any letting, moving out and previous sales on one timeline. Keep the corresponding records in a separate folder. The aim is to present verifiable circumstances, not construct a convenient story afterwards. Mark an unknown date as a question and locate the original document rather than guessing.

Resolve uncertainty before selling

If the property’s use changed or several sales are close together, send MTA a specific written question. Include the timeline and identify the uncertainty. “Is an apartment sale exempt?” is less useful than a complete description. Keep the reply with your question so the facts underlying the explanation remain clear.

Do not commit all the proceeds immediately

Prepare two personal budgets: one with an established exemption and one while tax treatment remains unresolved. In the latter, keep a reserve until the position is clear. This is a budgeting method, not a tax calculation. Separately account for the loan, moving and your next home. The buyer’s price alone does not show your freely available funds.

How to explain your circumstances to MTA

Prepare a factual timeline: acquisition, periods of residence, any letting and the intended sale date. Add dates of earlier home sales. Identify separately any parking space or storage unit being sold as a separate property. Asking only whether tax is payable does not describe the circumstances. Note what is still unknown as well. Complete background information reduces the risk of applying a general answer to a transaction with materially different facts.

Do not substitute an address entry for the facts

MTA’s guidance focuses on actual residential use. An address registration change alone does not explain how the property was used. Retain truthful existing records rather than constructing an apparent history before selling. If residence, letting and sale periods overlap, or records conflict, raise those facts before finalising the price. Neither a fast transaction nor the type of buyer automatically resolves the seller’s tax position.
